Freedom of speech and appellate victory

On April 7, 2025, Honor Society prevailed in a First Amendment appeal before the United States Court of Appeals for the Fifth Circuit. In the appeal involving Phi Theta Kappa and Honor Society, case No. 24-60452, the court vacated a preliminary injunction restricting online speech and remanded the case to the district court. [16]

What the court decided

The appellate court concluded that the injunction imposed an overbroad prior restraint on speech and impermissibly compelled speech through a required disclaimer. Its decision addressed the constitutional problems with that injunction; it did not decide the merits of all underlying claims. [16]
